Here’s why you can’t buy the newest Apple Watch in the US

Apple has been embroiled in a patent dispute that has resulted in the importation ban on its latest watch offering into the United States.

The U.S. International Trade Commission (ITC) ruled that the company could no longer import the product into the United States after a complaint about the blood oxygen sensor used in the latest Apple Watch was filed by Masimo, a technology company.

The Apple Watch SE which is still on sale by third party sellers like Amazon and Best Buy has not been affected by the importation ban because it does not include the blood oxygen sensing technology. However, the Apple Watch series 9 and Apple Watch ultra 2 have been affected.

An emergency request was filed by Apple at the U.S Court of Appeals for the Federal Circuit to stop the ban. The U.S Customs and Border Protection will make a decision about it on January 12.

Apple said in a statement, “We strongly disagree with the USITC decision and resulting exclusion order, and are taking all measures to return Apple Watch Series 9 and Apple Watch Ultra 2 to customers in the U.S. as soon as possible.”
